Can I sue the person I know stole my checks and signed my name in civil court / and those that accepted them?
mother out law asked:
My mother in law stole some checks from me and wrote them all over town. THe accounts were closed but the merchants did not check the accounts and accepted the checks. It is up to 3500.00 and she is still going. Can I sue her and the merchants who took the checks as well?

Sue them for what? Unless they try to recover the money from you they are the ones who have been injured.
You need to pursue legal action first. Have you even filed a police report? After she has been found guilty of the crime in criminal court you can sue her in civil.

You must file a police report. Then, you must take that police report to your bank, and contest the fraudulent checks. The bank SHOULD (but may not) return your money, and then THEY will be the victim.
You will also have to press charges for identity theft against your mother in law.
You will ALSO have to put a fraud alert on your credit report and challenge (dispute) any fraudulent activity, such as erroneous Chex Systems or TeleCheck notations on your credit report.
you can always sue — winning is something else — you would be better off calling the police — if the accounts were closed you should not be libel for the bad checks!!!
Do the police report. Then call Trans Union Fraud Dept toll free @ 1-800-680-7289. They will notify the other 2 bureaus for you at no charge.
